Welcome to Free POS Guys. These Terms of Service govern your use of our website, solutions, and hardware terminal placements. By accessing our site or using our payment systems, you agree to comply with and be bound by the following terms. If you do not agree to these terms, please refrain from using our services.

1. Hardware Placement & Qualification

Our "Free POS" and "Free Smart Terminal" programs are promotional placement agreements:

• Eligibility: Placements are reserved exclusively for active, qualified US-based business entities that process credit card transactions through our designated compliant merchant processors.
• Ownership: All provided smart terminal devices (including VL100, VL110, VL300, VP300, VP550, and VP800 models) remain the property of our merchant processing networks. If you choose to terminate your merchant agreement, all terminals must be returned in good working order to prevent terminal replacement charges.
• Upgrades & Maintenance: We provide ongoing device updates and warranty exchanges at no cost during the active term of your merchant processing partnership.

2. Compliant Processing Programs

Free POS Guys sets up dual pricing, surcharging, and cash discount structures according to federal, state, and card network regulations. By implementing these programs, the merchant agrees to display all compliance signage provided by us clearly at cash registers and point of sale stations, and to follow terminal operations guidance verbatim.

3. Lead Submissions & Auditing

By submitting statement audits, savings calculator inquiries, or contact forms, you verify that all provided data is true and represents your business operations. You agree to receive direct operational updates, email schedules, and telephone check-ins from our USA-based merchant support team. 4. Limitation of Liability

Free POS Guys provides secure payment routing gateways and terminal systems. However, we are not responsible for any operational business disruptions, processing network downtimes, or bank deposit delays caused by third-party card networks, carrier networks, or processing partner clearances. Access to funding is subject to standard processing batch-outs.

5. Modifications of Terms

We reserve the right to modify these Terms of Service at any time. Any changes will become effective immediately upon posting to this page. Continued usage of our website or POS solutions following modifications signifies your active acceptance of the revised terms.

6. Governing Law

These terms are governed by and construed in accordance with the laws of the State of New Jersey, without giving effect to conflict of laws principles. Any legal actions or proceedings arising from these terms will be brought exclusively in state or federal courts located within New Jersey.
